Milan Court of Appeals Acquits Director in €1 Million Tax Evasion Case

In a detailed ruling spanning over 100 pages, the Milan Court of Appeals has acquitted a defendant previously convicted for alleged tax evasion. The Court ruled that ’the act does not constitute a crime,’ accepting the argument that the defendant had no effective role in the company’s operational and administrative management. […]

Fraudulent Bankruptcy: Director Acquitted, Professor Convicted

The criminal case against a law firm’s secretary for offenses in the management of a bankrupt company has concluded with a full acquittal. The Court of Milan ruled that the woman, the company’s formal director, was entirely uninvolved. The judge recognized her appointment was purely nominal, lacking decision-making power and subordinate to the control of the de facto director, a well-known lawyer and professor at LUISS Business School. Sessa, who also advertised himself via TV and the internet, had promised an entrepreneur in the Certosa area that he would resolve his tax debt through the purchase of a VAT credit (which was actually non-existent) that a company would allegedly transfer at a discounted price: with this deceit, the two co-defendants managed to be handed a staggering €106,880 from the victim in transfers, checks, and cash.
